Terms of Use

These Terms of Use are an integral part of the Distance Contract concluded by the parties on the basis of the Customer's order in the online store www.piensnofermera.lv (hereinafter – the Online Store).

By placing an order, the Customer confirms that they have read, understood, and agree to the Terms of Use. If the Customer does not agree with the Terms of Use, placing orders in the Online Store is not permitted.

The Distance Contract remains in force until its obligations are fully fulfilled.

1. Definitions

Seller – SIA “AKD”, registration No. 40203435299, legal address: Lauvu iela 31, Berģi, Garkalnes parish, Ropaži municipality, LV-1024, which ensures the operation of the Online Store www.piensnofermera.lv.

Owner of the Online Store is SIA “AKD”, which sells products of SIA “Labradors”, registration No. 40003387884.

Customer – a natural or legal person who places an order in the Online Store.

Delivery – delivery of the Customer’s ordered goods to the address specified by the Customer via courier service.

2. Ordering

2.1. When placing an order, the Customer must provide their name, surname, phone number, email address, and precise delivery address.

2.2. The Customer is responsible for the accuracy and truthfulness of the provided information.

2.3. Notifications related to order fulfillment (order confirmation, invoice, delivery information, etc.) are sent regardless of the Customer’s choice regarding receiving marketing communications.

2.4. Personal data is processed in accordance with the Privacy Policy and applicable laws and regulations.

3. Price, Payments and Delivery Costs

3.1. All prices in the Online Store are indicated in EUR, including value added tax and other applicable taxes. Goods are sold at the prices valid at the time the order is placed.

3.2. In addition to the price of goods, the Customer pays a delivery fee. The delivery fee is calculated automatically according to the selected delivery location and courier tariffs.

3.3. Payments are possible only using the payment methods indicated in the Online Store. Payment must be made before receiving the goods.

3.4. When making a prepayment using a debit or credit card (VISA, MasterCard, Maestro), the Customer must have secure online payment functionality activated. After entering payment details, the order amount is charged from the Customer’s account.

3.5. After receiving the order, the Customer is sent an SMS notification confirming the order.

4. Product Assembly and Delivery

4.1. The Seller strives to ensure the availability of all ordered products; however, in the event of unavailability of certain products, full order fulfillment is not guaranteed.

4.2. Delivery is made to the address specified by the Customer. Order delivery is carried out by SIA “Labradors” or a cooperation partner.

5. Quality Guarantee and Liability

5.1. The product shelf life is determined by the manufacturer. Products must be stored at a temperature from +2 to +6 °C. Improper storage conditions may shorten the shelf life.

5.2. Only dairy products of Latvian agricultural origin are sold.

6. Right of Withdrawal and Refund

6.1. Considering that perishable food products are sold, the Customer is not entitled to a 14-day right of withdrawal in accordance with applicable laws and regulations.

6.2. If the Customer determines that the product is damaged or does not comply with the order, the Customer must contact the Seller within 24 hours from the moment of receipt, attaching a photo of the defect.

6.3. In case of a justified claim, the Seller shall arrange a refund to the account from which the payment was made.

6.4. If the product meets quality requirements and has been delivered in accordance with the order, returns are not possible.

7. Order Cancellation

7.1. In case of force majeure or other significant circumstances, the Seller may temporarily or fully suspend the operation of the Online Store. In such cases, payments for undelivered orders are refunded within 7 working days.

9. Dispute Resolution

9.1. Disputes regarding the performance of obligations are resolved through negotiations.

9.2. Consumers have the right to use out-of-court dispute resolution options by contacting the Consumer Rights Protection Centre.

9.3. These Terms of Use are prepared in accordance with the laws and regulations of the Republic of Latvia. All disputes are subject to the courts of the Republic of Latvia.

9.4. The Seller has the right to unilaterally amend these Terms of Use by publishing the updated version in the Online Store.

10. Data Processing and Protection

10.1. The Customer’s personal data is processed to ensure order acceptance, execution, delivery, preparation of accounting documents, and fulfillment of financial obligations.

10.2. Personal data processing is carried out in accordance with the Privacy Policy and applicable laws and regulations.
